July 22, 2010
The Board of Directors met at the Community Center on July 22, 2010. The Directors present were Chairman Brad Riggs , President Mike Zavorka, Larry McKenna, Connie Hargis, Bob Campbell, Buddy Moore, Paul Scherrer, John Ossenfort, Treasurer Gay Sellers, and Secretary Carol Eubanks.
- Absent were Chuck Nitsch and Nick Terry.
- Chairman Brad Riggs called the meeting to order at 7:04pm..
APPROVAL OF MINUTES
The minutes will be corrected as noted. Connie Hargis made a motion to accept the minutes of June 24, 2010 with corrections and was seconded by John Ossenfort. All voted aye. No nay. Motion passed. Corrections were made and then posted.
TREASURER’S REPORT
Treasurer Gay Sellers reported:
- The treasures report was read.
- Bud Moore asked that the survey done in April be taken out of Timber harvest.
- President Mike Zavorka enquired if AmerenUe had stopped billing us for the light at the end of North Lake Dr. Gay Sellers said yes.
SECRETARY’S REPORT
Secretary Carol Eubanks reported:
- Christopher Paul are selling Block C Lot 45 to Jimmy & Shirley Amsden and Everett and Paula Pratt are selling Block G Lot 25 to Timothy Paulus and Linda Guillaume.
- Carol Eubanks talked to Graham-Pierce printing about getting more stock certificates. The price went from $56 for 40 shares to $306 for 40 shares. So we got prices and found the cheapest price at Office Depot of 50 shares for $85.
PRESIDENT REPORT
- Bob Campbell did a great job on the new rope and buoy‘s. Bob Campbell thanked those who helped with the rope and buoy’s. Chairman Brad Riggs did a great job on the floating dock. Chairman Brad Riggs said there were about fifteen people working on the floating dock with him.
- Ms. Keisel has extended the lease to the Miller’s for 6 months and that will be the last extension.
- Block F Lot 39 President Mike Zavorka signed a sale’s contract. It will sell next week to Clint and Tracey Mattson.
- Clyde Pratt has rented out a house on the North Lake Dr. and the renter will be purchasing it in 2 months.
CHAIRMANS REPORT
Chairman Brad Riggs said they put a turn buckle on the floating dock so that it relieves the tension on the cable.
OLD BUSINESS
- Chairman Brad Riggs asked if Floyd Norrick sent out the demand letters. John Ossenfort said not yet. We will look at changing our lawyer after September.
- Paul Scherrer enquired about the sign up front being painted. Bud Moore talked to Ron about putting an aluminum sign over the exiting sign and vinyl lettering for $200-$250 with a guarantee for eight years. Chairman Brad Riggs said nothing can be done until after the fiscal year.
NEW BUSINESS
- Connie Hargis said we put an ad in the Leader that the lake will be lowered to let the people down from the lake know.
- Rives Maddox is building a garage for his golf cart. He has been asked to cease building because he does not have a building permit.
- Larry McKenna said Bill Sellers showed him an area where the shoulder of the road is giving way.
Dam: Paul Scherrer said he will be spraying the dam next week.
Paul Scherrer will get some dye to check were the leak on the dam is.
Josh Hogan cut the dam for $1500. David Mikusch will brush hog around the brush pile.
Beautification: Larry McKenna said the Dangerous curve sign is up.
Publication/web: Bob Campbell said he put the electric inspection up on the web site.
Security: Connie Hargis said there will be two bills for the display screen on the call box. A service call for a heavy static charge in the air that made the fuses fry and needed to be replaced. The last call was because AmerenUe took out the cover to the call box.
We are down by one security guard. Bud Moore filled in for the 4th of July.
Bud Moore: Bud Moore said he filled the holes at Pioneer Rd.
The people with gravel driveway’s need to please clean the gravel off of the road after a rain storm because it will tear up the road.
He put reflectors on the floating dock.
He spoke to DeSoto Electric about the light up front to be replaced. A 65 watt florex bulb will cost $186. Chairman Brad Riggs asked if they will give us a price for digging a hole to put a pole in.
Finance: John Ossenfort said he had nothing else.
Docks: Chairman Brad Riggs said he has the letters ready to be sent out to those with derelict docks that must be repaired or the current owners will lose possession of the dock.
Connie Hargis made a motion to adjourn the meeting and Paul Scherrer seconded it. All voted aye. Meeting adjourned at 8:50pm.

APPROVAL OF MINUTES
The minutes were approved. Paul Scherrer made a motion to accept the minutes of May 27, 2010 and was seconded by John Ossenfort. All voted aye. No nay. Motion passed. Minutes were posted.
TREASURER’S REPORT
John Ossenfort reported:
The treasures report was read.
PRESIDENT REPORT
Dave Mikusch and a friend were scuba diving by the dam and they came across a 14 to 16 ft. boat. It is down by the dam on the last dock. It has no lot numbers on the boat. It looks to have been on the bottom of the lake for a while.
- There is a lady interested in purchasing Block F Lot 39.
- President Mike Zavorka is still working on the survey. Chuck Nitsch talked to the gentleman at Associated Land and depending on what is left to survey the top amount to resurvey will be $400.
- President Mike Zavorka has talked to Ms. Kiesel about the Miller’s and their boat. On June 30th the lease will be renewed. It is a lease to own. Ms. Kiesel will get the boat removed from the lake.
CHAIRMANS REPORT
- Chairman Brad Riggs said Eric got a plastic tub for the floating dock. Chairman Brad Riggs cut the tub down and has the rebar all ready to be put on the floating dock. He has the anchor done. Alan Schuh pulled the floating dock down to the marina. The floor boards will need to be replaced. Paul Scherrer said the floating dock needs a turn buckle to keep the line from being frayed. Paul Scherrer made a motion to spend up to $500 to repair the floating dock. Bob Campbell seconded the motion. All voted aye. Motion passed.
- Mary Lovato received her certified letter. She came to see Chairman Brad Riggs about her son who is living in her house. He is not keeping up his end of the agreement. She will be selling her lots. Chuck Nitsch has put up one of the posts for the gate on the bridle path. He is waiting for the gate to put in the other post.
SECRETARY’S REPORT
Secretary Carol Eubanks reported:
- Diane Bolin sold back her shares of stock and an offer was made to the next person on the list.
- Susan McKenna asked if Jake Taylor could trim back the trees on the curve so that you can see on coming vehicles.
OLD BUSINESS
President Mike Zavorka went to Orchlein’s and got the parts to repair the sprayer. Jeff Zavorka sprayed the beach and the flag pole. He will do it again before the 4th of July. The dam needs to be done yet.
NEW BUSINESS
- Steve McKenna told Chuck Nitsch that someone took a pick up truck into the back acres using the bridle path between Blocks E & F. Chuck said they ruined a couple of water bars.
- John Ossenfort got a complaint that the Hargis’s son was hitting golf balls down at the beach area while people were around. One went into Ms. Keisel’s flowers.
- Doug Dieckman asked about dog’s on the beach area. Connie Hargis said that no dogs are allowed from the creek through the beach area.
Beautification: Larry McKenna said he has the sign ordered for the dangerous curve.
Dam: Paul Scherrer said Josh Hogan is going to brush hog the dam for $1500 by the end of the month. After it is done David Mikusch will cut it each month. The left over dirt and rock from the sewer company will be put up against the dam. He will put fill dirt on top to make it smooth.
There are a couple hundred trees that they are removing. There are currently ten root balls by the burn pile. If they are small root balls they can go into the burn pile. The larger ones will be hauled away.
Paul is keeping a watch on the leak at the spillway. When Mark Easter comes in to do the channel, he will over figure a yard of concrete and put it on the corner to help stop the leak at the spillway.
Water Quality: Chuck Nitsch said the M5 manhole has been taken out and a new custom structure was put in at the dam. There is a cast iron pipe across the spillway and an abandoned concrete pipe over it. When they stopped using it they did not remove the concrete pipe. They put concrete over the end of the manhole. It is now destroyed. The other end is at the spillway. He said that when we drop the lake he will plug the end by the spillway.
Chuck will replace three camera’s for security. He replaced the DVR unit. Chuck said he will replace the light up front with an infrared bulb.
Security: Connie Hargis said there was a robbery June 6th and camera that records license plates stopped working. On the 7th she noticed that the camera had peanut butter on it. The police fingerprinted the gate arm. At 12:03am on June 7th someone forced open the gate. They recognized who the person was and 36 hours later they were caught. She asked the detective to add on criminal trespass, vandalism, and destruction of property to the other charges for the robbery.
The second incident this month was that the guard confiscated a gate card that Bob Campbell’s son left up in the flower pot to allow his friends into the lake.
Bud Moore: Bud Moore said he put up the nine signs around the lake. Up front he replaced and put up new reflective stripes. He replaced the reflectors at the cattle gate.
John Ossenfort and John Koch replaced the light up front and it only lit for a moment. Bud and his son replaced the bulb up front with a 150 watt bulb and it still did not work. The light is bad. John Ossenfort has a fixture to replace it with. President Mike Zavorka said that DeSoto Electrical Products has a bucket to get you up to the light. Chairman Brad Riggs said to get an electrician from them also. John Ossenfort said that the line from the shed to the guard shack needs to be raised by the electrician also.
Publication/web: Bob Campbell said we need a new line and buoys. The money was allocated last year and Bob will get the job done.
Finance: John Ossenfort said he sent off a list to Mr. Norrick about the past due accounts. If we want to force a sale on a property we may or may not get our money because the first $15,000 the owner gets, the lender gets the mortgage still owed amount, and real estate taxes must be paid. If there is any money left we can get paid. Mr. Norrick is willing to this if we want to do so, but he does not recommend a garnishment.
Docks: Chairman Brad Riggs said after July 4th he will begin working on the letters to go to those who have derelict docks. If the dock is not repaired by the present owner the dock can be turned over to a new owner.

• Block C Lot 65 was sold to Jimmy & Shirley Amsden and 117 North Lake Dr was sold to Kevin Charleville.
• Mary Schuhwerk’s daughter sold back her mother’s shares of stock.

CHAIRMANS REPORT
• Chairman Brad Riggs said his wife scheduled the Johnny on the Spot and they were here today to deliver them.
OLD BUSINESS
• Nick Terry said we sold the Huskavarna lawn mower for $626. President Mike Zavorka will give the owners manual to Nick Terry to pass on to the new owner.
• Larry McKenna would like to purchase a dangerous curve sign to put up on the existing pole. Chuck Nitsch made a motion to buy the sign and Bob Campbell seconded it. All were in favor except John Ossenfort who voted nay. Motion passed. Connie Hargis asked if we had any old signs to replace the speed limit signs that are rusting.
• Treasurer Gay Sellers gave Connie Hargis the vehicle sticker book, but she will need it back from time to time.
• Chairman Brad Riggs said he had not put the back hoe on Craig’s list yet.
• Paul Scherrer said the sign up front needs to be repainted. President Mike Zavorka said he will get a price on how much it will cost to paint the sign and bring it to next months meeting.
• President Mike Zavorka asked Chuck Nitsch to find out how much it will cost to redo the survey and he will then get with the gentleman who moved the stakes about paying to have it redone.
• Paul Scherrer talked with Harley Hargis and Jim Luther about lowering the lake on Monday, September 13, 2010.
NEW BUSINESS
• Bud Moore asked about calling on vehicles that are unlicensed. President Mike Zavorka said you need to call Solid Waste and tell them who you are, and they will confirm who you are before they come out. If you call on one vehicle you will need to call about all the vehicles on the lake that are unlicensed.
• Chairman Brad Riggs said that if someone wants a sheet metal roof on their home they will need to apply for a variance and bring it before the board for approval.
• Connie Hargis asked why the lake board needs four copies of building plans. Chairman Brad Riggs said the lake must sign off on the plans before the building commissioner and the fire department sign off on the plans.
• Larry McKenna enquired about the toilet on the front of a boat.
• President Mike Zavorka said Mike Miller does not own property on the lake, so he should not have any boat(s) in the lake. President Mike Zavorka will talk to Ms. Kiesel about renters not having boat(s) on the lake.
• President Mike Zavorka asked Nick Terry to make payment for the web site.
• President Mike Zavorka wants to profusely thank Bill Sellers for cleaning up the road by the marina.
• President Mike Zavorka has a tentative sale on Block F Lot 039. The buyer will pay the closing price.
• Chairman Brad Riggs said the board needs to start bringing in ideas on what to do about the assessments for the future.
Beautification: Larry McKenna had no new business.
Water Quality: Chuck Nitsch said the three coves on the north side are covered in blanket rock and are doing their job cleaning the water that goes into the lake. President Mike Zavorka said thank you to the sewer board for all the work they have done and everyone agreed.
Security: Connie Hargis said she has the names of three police officers and has talked to two of them. She hired Steve Kissell and is working on hiring the other two. We still need cameras and the light still needs to be replaced up front at the gate.
Publication/web: Bob Campbell said the newsletter is done. He will need money for stamps. For anyone wanting to advertise in the newspaper the space it will cost $90 for business card size and $150 for double that size.
Roads/grass: Nick Terry said cracks in the roads will be repaired in the fall. Chuck Nitsch said it would cost $200-$225 for a load of rock to fix the South Lake Dr. side of the road after the bridle path in section F instead of letting the road be undercut.
Bud Moore: Bud Moore said he received all but one sign he had ordered. He was unable to find the posts that were in the shed. Connie Hargis said that there were twenty-four of them, and maybe they were used elsewhere. There are two signs-Don’t be a Litter bug that will go under the speed limit signs outside the gate, two signs-All vehicles must have Lake Wauwanoka stickers beyond this point that will go at the end of North and South Lake Dr., two signs-Slow Children Playing that will be at the bottom of Lake Wauwanoka Dr., two signs-No Parking Anytime that replace the ones near Pioneer Rd., one sign-Shooting Range Closed After Dark that will be on the trail to the shooting range, and six posts.
Bud Moore enquired about putting two fifty-five gallon drums up at the gate for people to throw their trash in. President Mike Zavorka said Steve Millichamp can get them for him. It was decided not to put them up.
Bud Moore inquired about clearing out an area back by the burn pile for residents to put their boats. It was decided not to do this because damage would occur to the boats or people may abandon them and Lake Wauwanoka, Inc. would be responsible for the damage.
Doug Enyart came out and looked at the woods. He said it would be $5000 for him to come out and harvest the back acres for 10 days worth of work.
Dam: Paul Scherrer said the manifold on the sprayer is cracked because there was a little bit of water left in it last year. President Mike Zavorka said the part to fix it is $29.99. He will get it from Orslon’s.
Jim Luther and Paul Scherrer stained half the bridge today and will finish the job next week.
Finance: John Ossenfort said he has the list ready to send to Floyd Norrick of those who are more than a year past due on their assessments. He will send out another letter after September of 2010 to Mr. Norrick of those that have not paid this year’s assessment.
Docks: Chairman Brad Riggs said he has not got the list completed yet of who has a derelict dock that will need to be repaired or gotten rid of when the lake is lowered.

CHAIRMANS REPORT
Chairman Brad Riggs had an e-mail from President Mike Zavorka in regards to the survey stakes that were moved. Mr. Brian Brooks’ said his children moved the stakes. Chuck Nitsch stated that the survey can’t be recorded because the survey stakes were moved and that Mr. Brooks should pay to have the survey redone. Chairman Brad Riggs will have President Mike Zavorka follow up on payment.
OLD BUSINESS
- Chuck Nitsch has made out a letter to Ms. Lovato in regards to no longer using the bridal trail as a way to get to her house. She will need to put in a driveway.
- Connie Hargis asked if Gay Sellers had the list together, to put in the guard shed, of who owns what vehicle. Gay has it all done except to put holes in the sheets to put in the binder. Connie said she has a three hole punch to complete the binder.
NEW BUSINESS
- Connie Hargis said the suggestion box rotted off. It was decided that we will not replace the suggestion box.
- Chuck Nitsch said that there have been people back at the gun range firing their gun(s) at 10:00pm.. Bud Moore will work on getting together a couple of signs: One on the gun range and one at the end of South Lake Dr. The sign should read daylight shooting only and stickers required on vehicles.
- Connie asked what the purchase price of stickers are. Does the sticker price for residents need to increase? Chairman Brad Riggs said we should not increase them at this time.
Beautification: Larry McKenna had no new business.
Dam: Paul Scherrer said that the First Aid class was a success. There were 16 people in attendance.
Water Quality: Chuck Nitsch said he finished clean up operations back on pond #2. He put wheat and clover seed in field #1 & #2 and he put fescue & clover around pond #2 & #3. He gave Wally some wheat & turnip seed to put down at the sewer plant and the old burn spot. He finished Block B culvert pipe for the sewer and the A cove project he put some blanket rock along the creek.
Publication/web: Bob Campbell said he put some pictures from the riding club from the 50’s & 60’s on the web site. He updated the events calendar with time of the event not just the date. He will post on the web site a letter from LWSewer that DNR has requested that the sewer company inspect houses for rain water and sump pump discharge that should not go into the sewer. He will be working on the May’s newsletter so if you have anything to put in the newsletter he will need it in the next two weeks.
Security: Connie Hargis said over the weekend someone pushed up the gate and pushed down the camera. Chuck Nitsch will be purchasing some new camera’s for night viewing.
Connie has names of three Hillsboro police officer’s who may be interested in working the weekends for us from Memorial Day to Labor Day.
Bud Moore: Bud Moore is having a Forestry consultant Doug Enyart coming here Thursday to talk to us about a 20 year program on the back acres. Mr. Enyart is recommending that we not take out too much timber right now because the market is down.
Finance: John Ossenfort wondered if anyone had talked to Floyd Norrick about the sale of the Anton property because he received a bill for services rendered. The board said no.
Connie Hargis asked if we have gone ahead with collections of past due accounts. John asked if we want the lawyer to be our collection agency and everyone said yes.
Chuck Nitsch made a motion to adjourn the meeting and Larry McKenna seconded it. All voted aye. Meeting adjourned at 8:31pm.

March 25, 2010
The Board of Directors met at the Community Center on March 25, 2010. The Directors present were President Mike Zavorka, Larry McKenna, Paul Scherrer, Chuck Nitsch, Nick Terry, Bob Campbell, Constance Hargis, John Ossenfort, Treasurer Gay Sellers, and Secretary Carol Eubanks.

President Mike Zavorka gave a dedication for Lou Serigo who passed away on Friday, March 12, 2010.

- Nick Terry gave Carol the gate access cards and remotes to hand out.
PRESIDENTS REPORT
President Mike Zavorka reported that Mr. Scheske’s boat has been removed.
President Zavorka reported that he talked to a former resident about selling back their stock to the lake. There are now forty shares available to resell.
President Zavorka received a telephone call from Tim who owned Hilltop Trash Service who sold out to IESI. His five years are up and he is getting back in the trash removal service. Connie Hargis stated that we still have 3 years left on our 5 year contract with IESI.
President Zavorka stated the corporation owns Block F Lot 39 and he wants to sell the property. Chuck Nitsch made a motion to sell the lot for $4,000. Bob Campbell seconded it. All voted aye. No nay. Motion passed.
President Zavorka received a letter from American Family Insurance. They have made an administrative adjustments to our Crime fidelity and employee dishonesty policy effective April 4th.
President Zavorka discussed whether or not the board wanted to keep the lake e-mail account. It was decided that yes we would like to continue having the e-mail account.
Bob Campbell asked about the meeting with Mayor Roland. President Zavorka said he met with the mayor and Gary Marmaduke. He said we will have to wait and see what happens with the storm sewer the city of Hillsboro is putting in, and then the board will make a decision on what will need to be done. Chuck Nitsch would like to talk to the mayor about the storm sewer with President Zavorka.
OLD BUSINESS
- Nick Terry asked about the lawyer who came to speak at last months meeting. Chairman Brad Riggs thinks now is not a good time to change lawyers. President Zavorka said any new business we get could be put his way.
- Paul Scherrer thanked President Mike Zavorka for his help getting the bobcat repaired.
- Paul Scherrer said he will try to burn by April 15th.
- Nick Terry said we will be getting back the mower that he sent out to be repaired. It will cost about $300 to be repaired. He will put it on Ebay for $600-$800 when it comes back. President Zavorka asked that he also give Bob Campbell the information to put on the Lake Wauwanoka web site.
NEW BUSINESS
- Paul Scherrer said the shed needs repairs, the sign at the entrance needs repairs, the sign at the marina is falling over, and the rope & buoy’s will need replacing. President Mike Zavorka said the rope and buoy’s will cost $400-$500 to replace and we don’t have the funds at this time. Paul said the shed has a bad truss and it needs to be painted. Nick Terry said he will contact someone about how much it will cost to paint the shed.
Water Quality: Chuck Nitsch said that Ms. Meyering’s culvert needs a pump to jet out the culvert pipe.
Chuck had Associated Land do the survey. Brian Brooks pulled out some of the survey sticks, moved the sticks, and destroyed the survey. The stakes left alone did follow the fence line. We could sue him in small claims court. President Zavorka will talk to Samuel Brooks, his father.
Chuck stated the residents at E 053-057 are still using the bridle path by the low water bridge and it is mudding up the water. Chuck will be sending a letter to them about closing off the bridle path and they need to cut in a driveway.
Edward Moynihan inquired about the sewer work being done. Chuck will draft a letter about what was being done to the drainage area.
Dam: Paul Scherrer said the EMA is going to have a meeting Monday. One of the captains of the Hillsboro fire district is going to do a first aid class April 17th from 10am until 11:30 am for the EMA members and the residents.
Paul brought in pictures he has been storing for the riding club to give to Mr. Campbell to put on the web site.
Paul said Larry Gooden will send a letter to the board to ask permission about a bus tour and an open house in June.
Chuck asked to just keep him informed about the spillway repair because he would like to put a camera up the sewer line to see if it is bad.
Beautification: Larry McKenna had nothing new.
Finance: John Ossenfort said that we have been collecting assessments.
Security: Connie Hargis said March 4 the gate arm was off for 4 days to replace the mother board in the gate arm box. A week and a half ago someone came in and ripped the card reader off the stand. It could not be determined who damaged it.
Connie filed a police report in November. She called Mr. Gravagna and spoke with him. He came over and paid for wrecking the gate.
Connie asked for an update from Gay on who gets issued what stickers. She would like it for security so they can check the car sticker numbers to find out who belongs to vehicles that are not where they are suppose to be.
Chuck Nitsch said thank you for your work at the gate and everyone else said thanks.

The Board of Directors met at the Community Center on February 25, 2010. Bob Campbell had Scott McKinnis, a lawyer, talk to the board about hiring him in the future. His rate is $175 per hour.

President Mike Zavorka reported the Rod and Gun Club agenda of March 28th a turkey shoot, April 3rd an Easter egg hunt, April 25th a CCW class, May 8th a fishing tournament, May 30th a band and July 3rd a picnic.
President Mike Zavorka said the city of Hillsboro has a lease with the school district and they are going to put in a storm water sewer along Vreeland Rd. Next week he will go to Hillsboro court house and look at their plans and then we will make a decision about whether or not we need to do anything about it, because it may discharge too much water on our property.

Docks-Chairman Brad Riggs had nothing new.
Water Quality: Chuck Nitsch said they were going to move the sewer in cove A, but instead they will leave it were it is and move the culvert. They will put the pipe in, put the granular back fill in, compact the fill, lay a bench of quick drying concrete, and then asphalt the road.
There is a bridle path between A 108 and B 59 that is 25ft wide. There are 3 dead trees on the bridle path that need to come out as soon as possible. He needs to establish a proper water way. Chuck said he needed a motion to remove the trees. Paul Scherrer made a motion to spend $1500 out of water quality to remove the trees and correct the bridle path. Connie Hargis seconded it. All in favor aye. No nay. Motion passed.
Chuck said an Amy Clark resident is in suspicion of encroachment on the Lake Wauwanoka property. He recommends that we survey the area, and put some posts in & a fence or gate. President Brad Riggs said that originally the whole lake property had 7 lines of barbwire around the lake property. Connie Hargis made motion to spend up to $900 out of timber harvest to survey that area and Bob Campbell seconded it. All in favor aye. No nay. Motion passed. Connie has fence posts if needed.
Dam-Paul Scherrer said in the next week and a half he will have the people out to service the bobcat.
He will begin burning the 3rd week in March.
Publication/Web-Bob Campbell said he had new information to add to the web site, and is looking for any other new information anyone has about the lake or its clubs.
Bob inquired into what everyone thought of the attorney. Chairman Brad Riggs suggested that they discuss that at the next meeting.
Beautification-Larry McKenna had nothing new.
Security-Connie Hargis said Atlas Restoration made restitution. Connie said she will talk with Nick Terry about Mr. Gravagna about whether or not he has heard anything about when he is going to pay for wrecking the gate.
Bud Moore-Bud Moore said he called Missouri conservation and they are sending him brochures on how to keep good tree growth. He has a list of names from Call before you Cut. He called a gentleman from the list and is waiting on a call back from him. Connie gave him a name of a logger in Fenton to call.
Finance-John Ossenfort said we did get a number of assessment paid last month. We only have two that meet Mr. McKinnis’s criteria for getting our money on past due assessments. Now we need a sheriff’s sale on those properties. Chairman Brad Riggs will check with a lawyer about garnishing, taking their vehicle, and selling their property.

The Board of Directors met at the Community Center on January 28, 2010. Chairman Brad Riggs stated that our meeting date was incorrect, it should be December 3rd instead of the 5th, on the last sentence under Publication/Web it should be at the instead of a, and under Docks remove the statements after the Furtaw dock. John Ossenfort stated that under the Chairman’s report the report is due by January 31, 2010 not December 31, 2009. Bob Campbell asked that the statement be reworded under the first of old business. - Grace & James Dawson bought 142 North Lake Dr. from Richard and Barbara Kahle. Mr. Dawson is asking for information on lake association meetings, assessments, trail area, 4 wheeler area and hunting area.
PRESIDENTS REPORT
President Mike Zavorka thanked Bob Campbell for the excellent news letter. Bob Campbell said it took his wife two nights to do this first one but the next one should only take about two hours. President Mike Zavorka said the snow removal was done. Connie Hargis asked how much snow comes down before you start the snow removal? President Mike Zavorka said right away. President Mike Zavorka said we need to get a legal answer on whether or not we can put the $25 aside and reissue the stock on those that we know have passed away.
CHAIRMAN’S REPORT
Chairman Brad Riggs asked about collections on those who have not paid their assessments. John Ossenfort stated we need to go before a judge and request a judgment. We then garnish their wages or go to their bank and collect. We will get the information together for the lawyer for the judgment in the coming weeks.
OLD BUSINESS
- Paul Scherrer received an answer on the backhoe attachment for the bobcat. They are willing to give us $1500. Chairman Brad Riggs offered to take pictures and put it on Craig’s list to try and sell it. They will come out and service the bobcat for $300. The fuel gauge, the tail lights and the grease fitting will be extra.
- Bob Campbell talked to Jack Stewarts office. His office said that they would not take on the tri-party agreement when Floyd does everything else. Mr. Mooniery could do it. It will cost anywhere from $500 to $1000 to research. Bob Campbell stated that we should find out if there is a precedent in regards to allowing renters. Paul Scherrer said that none of the current renters should be allowed because the homeowner did not come before the board and ask permission to have a renter. If a current renter moves out, the next time you want to rent out your home you must come before the board and ask permission to rent your home out again. Nick Terry will talk with a friend of his to get another name of an attorney. Chairman Brad Riggs said we will table this for a month.
NEW BUSINESS
Bud Moore asked if you buy in here does it have to be approved by the board. The board said no.
- Docks-Chairman Brad Riggs had nothing new.
- Beautification-Larry McKenna said they had worked the culverts all the way around and got the trees out. When spring comes they will start all over again.
- Dam-Paul Scherrer said the Department of Natural Resources and FEMA said we have three years to do a 15 page document. Ten pages of which he fills out and five pages are what to do if something happens. This is an emergency action plan. We legally must do it. He went to a meeting in Warrenton today. For the 5 or 6 people living behind the dam, you must get the owners names, phone numbers, and a list of who all live in the home. This goes into a data base. If the dam has a failure you must call 911, the local police and county sheriff’s office, highway department, and the state department. It must be updated yearly.At the spillway there has been a chunk of concrete that fell off. It was put there in 1988. It goes from two to five inches in depth from the door to the dam. DNR knows about it and said it must be replaced. It will be done when the lake is lowered in September.
- Roads/grass-Nick Terry said we will have Lawrence Lawn Care do the lawns again this year.Mr. Gravagna, the Burleson’s grandson, has not yet sent in payment for hitting the gate on November 22, 2009. He will send a letter to have him to pay within 30 days and if he does not pay we will turn it over to his insurance company.
- Water Quality- Chuck Nitsch said he did clean up around pond #2. Wally Schneider has volunteered to put down seed on the back acres. He put two area inlets on Algonquin Cir.. On the north side there are two area’s where the sewer is going to be replaced. One by 142 North Lake Dr. and one at the end of cove A. He does expect problems with the roads this year due to such a harsh winter.
- Publication/Web-Bob Campbell said he changed the charge for cards($20) and remotes($50) for access to the lake. The paperwork will go to the treasurer’s attention. The party code day pass request is in the newsletter and on the web site. Must request it two weeks before the event. They will get the code one week before the event. Rod & Gun club did not respond to the letter sent to them about the newsletter. Bob said the The McCoy family asked if there is anything that can be done about cleaning up and marking the public pathways. Chairman Brad Riggs said we are aware of the problem, but that is not part of the official budget. It will be looked at in the future.
- Bud Moore-Bud Moore said he has nine customers for the wood he has been clearing out. He is clearing out the dead trees before they rot. He would like to bring in a professional forester and look at the wooded area. Connie Hargis said we need to find out what trees should be taken out and which ones to leave to accelerate the harvest program, clear the woods, and giving everything a decent chance to grow good. The area they are looking at is north of the old harvest area. Bud Moore asked if anyone has any extra gravel to put in the hole out front. President Mike Zavorka told him to put some sand in it.
- Security-Connie Hargis said Altlas Restoration has contacted us about pictures of the damage to the box. The 3 men working that day have confessed to hitting the box. They will be making payment.The gate arm was off today. The bottom bolt on the gate came loose. President Mike Zavorka had fixed the gate.
- Finance-John Ossenfort said the registration report has been filed.

PRESIDENTS REPORT
- President Mike Zavorka said Jeff Zavorka and himself will get the boat out of the water that has been abandoned tomorrow.
- Jeff Zavorka cleaned the low water bridge & the beach after the big rain.
- Jeff Zavorka put a starter and the solenoid on the truck. David Mikusch re-welded the receiver on the truck.
- President Mike Zavorka called Valerie Kansteiner about the car next door. What the county said is if the car can move forward or backward it is legal.
- President Mike Zavorka talked to Pat Kiesel. The Miller’s have a purchase/lease agreement with her for the house. She will let us know when they purchase it.
CHAIRMAN’S REPORT
Chairman Brad Riggs said our official notice for registration report is due by the end of the year.
OLD BUSINESS
Chairman Brad Riggs enquired if everyone had received their tri-party agreement. Paul Scherrer stated that the “no rent” is attached to our property deed and we do not need to approve the tri-party agreement. Chuck Nitsch enquired if the property owner is supposed to ask for permission to rent their property from the board. If there is a no vote then they are denied. Bob Campbell said the restriction runs with the land and the deed. Whether a person has been renting here for 20 years or not they have been breaking the restriction that no one is enforcing. Unless there is a state or federal case that applies specifically to this question we have every right to not allow renters. He recommends that we talk to Mr. Brandon Mooniery. Chairman Brad Riggs asked Bob Campbell to talk to Mr. Mooniery. Chairman Brad Riggs said that #8 says you can not rent unless you have board approval. The tri-party agreement was tabled until next meeting.
Chairman Brad Riggs had the secretary mail a letter to Mark Matousek regarding his sheds.
Chairman Brad Riggs had a letter for Harley & Constance Hargis about whether they had a permit. Connie replied that they were removing and replacing the room. Mark McKenna, the building chairman, made a decision that they did not need a permit.
President Mike Zavorka stated that we should see if the company will come out and pick up the bobcat. It needs the fuel gauge fixed, two lights are broken on it, it needs servicing, and fluid & oil change. Chairman Brad Riggs asked Paul Scherrer to call them and have them come out and pick up the bobcat. At that time he should enquire about the need for forks for the bobcat & whether or not we get credit for the backhoe attachment.
NEW BUSINESS
President Mike Zavorka asked if everyone received the e-mail about who is on what committee. He stated that we are required to have 5 committees and we have 13.
President Mike Zavorka stated that the sewer debt to the corporation is approximately $35,000. With the new rate increase that will go into effect next year, He believe we should be receiving $1,000 a month instead of the $100 we currently are receiving. In 18 months we will be out of money. Connie Hargis stated that as long as she has a letter by Wednesday it will be read at the meeting.
Nick Terry stated there is some griping about the remotes and cards getting to residents. Would the secretary take over sending out the remotes and cards. He would just need to know the activation numbers so they could be traced when there is a problem at the gate. President Mike Zavorka inquired about how many cards can be transferred from prior resident to current resident. Nick Terry stated everyone received two free cards which can be transferred to new owners. The form on the website needs to be changed to $50 for remotes and $20 for cards.
- Docks-Chairman Brad Riggs recommends that we send a letter to Jake Taylor about not having proper documentation about the Furtaw’s dock and as such it will be turned back over to the Furtaw’s. The dock audit that was done does not show who is assigned to each dock. The next step is to send a letter asking the residents if they own the dock. If the dock needs repair then they will be asked to repair it. Then we will look into numbering the docks. He now has pictures of all the docks.
- Security-Connie Hargis stated she received a letter from the prosecuting attorney declining to prosecute Billy Tebeau. He and 3 of his friends were caught on tape trespassing onto lake property. They confessed to pushed the gate arm up. The call box incident with Steve Garvagna, he hit the box on Sunday and called Nick Terry and left a message. Nick Terry let Connie know on Tuesday that he called about paying for the repair. The Garvagna bill will be somewhere between $1200 and $1500. The second one, Atlas restoration came in to do repairs at Alex’s house and they took out the call box completely. It will run between $5,000 and $6,000. If you have anyone coming in with a vehicle larger than a van have them use the center lane and get out, call, and punch in the code. Chuck Nitsch stated someone cut the lock off of the Vreeland Rd. gate and they put a new lock on it. He cut that lock off and replaced it.
- Dam-Paul Scherrer said the concrete spillway will be repaired in the summer. September 7, 2010 will be when we pull the gate to drain the lake. It will take about 10 days to drop. If you need to do anything to repair your dock or seawall that now is the time. If you are putting in a new dock see Brad Riggs. Every 5 years we lower the lake 4 feet.He got 2 loads of gravel for $466.37. We have wood chips for mulch. They are available at the burn pile. President Mike Zavorka asked if we could burn other than Saturday or Sunday? Paul stated it had to be done then because of the weather.
- Water Quality- Chuck Nitsch stated he drained pond 2 and will clean up around it. Also the logging is done and he will clean up where they were.The ditches hold leaves and if you don’t burn the leaves right away they will get wet and then they stop the water from running in the ditches. There are ditches around the lake undercutting the road. He put rock in the ditches on his property, which he paid for. The material to do the job is $2-$3 a ft. He said out here along the entry road the ditches are getting deep. We will need a load of concrete and rock to repair it. It will cost about $2,000. Another place he would like to repair is at South Lake Dr by Algonquin Dr. The guard rail needs repair and make a shoulder. One other place that needs repair is by John Douglas’s house.
- Publication/Web-Bob Campbell inquired how often do we send out a newsletter? President Mike Zavorka stated 2 to 4 times a year. Anything that can be sent out electronically rather than by mail is terrific. He is working on how many can be sent out electronically rather than by mail. He inquired about a presidents report, the Rod & Gun Club information, when will snow plowing begin, fire wood from Bud Moore, speed limit, information about the back acres, culvert maintenance, EMA training, and future events. He asked about posting the last approved minutes. Chairman Brad Riggs said that would be fine. He asked about posting the treasurer’s report. Chairman Brad Riggs stated that we talked about that a last meeting and it is not necessary.
